The Ministry of Finance presents for public discussion the draft Law of Ukraine “On the Verification and Monitoring of State Transfers”.
What’s it about?
The Ministry of Finance has prepared the draft Law of Ukraine “On the Verification and Monitoring of State Transfers”. The main goal of this draft law is to provide a systemic legal and organizational basis for the verification of state transfers in Ukraine.
The draft law determines the main rights and tasks of the Ministry of Finance in the verification of state transfers. It also regulates key issues regarding the collection, processing, protection and analysis of information received from respective entities.
The draft law determines the main phases of verification, including:
1) preventive verification – verification taking place, when a private person approaches the entitled state authority to apply for welfare transfers from the state;
2) current verification – verification taking place, while state transfers are made for private persons;
3) post-event verification – verification taking place after the completion of state transfers to private persons.
Apart from this, a procedure has been developed to provide recommendations to state agencies making transfers as well as a procedure for the confirmation and cancellation of recommendations. Also, approaches have been developed regarding the refund of illicitly effected state transfers.
What’s the benefit?
The proposed draft law shall contribute to the development of a fair social welfare system in Ukraine. It will also make state transfers more targeted and help optimize public spending through the verification of information which impacts entitlements and the amount of state transfers.
What comes next?
After a public discussion, the draft law will be amended accordingly and submitted to the Cabinet of Ministers and the Parliament.
Verification of state transfers is a set of measures including the collection and examination of information determining entitlements and the amount of state transfers as well as the identification of incorrect data in automated information and inquiry systems, registers, databases and other sources of information about private persons who are entitled to welfare transfers and/or receive or already received such transfers as well as about private persons applying for such transfers. The analytical work based on verification shall also make it possible to improve the legislation on the assignment, calculation and delivery of state welfare transfers.
